TERMS AND CONDITIONS

By clicking the box on our Site marked “I have reviewed the Landlord’s Terms and Conditions and hereby agree to them”, you hereby agree that a legally binding contract between you and LetBritain comes into force on these Terms including but not limited to your obligation to pay the Registration Fee, the Advertisement Fee and the Landlord Fee as applicable.

LetBritain Global Limited trading as “LetBritain” provides a forum for prospective landlords to register their properties available for letting on LetBritain’s website and for prospective tenants separately registered with LetBritain to view such properties and to be introduced to the prospective landlords on the terms and conditions set below. Your attention is drawn to the following warning:

IMPORTANT INFORMATION

You should be aware that the Landlord Fee (as defined in these Terms), which is non- refundable once paid by you, is payable by you to LetBritain upon a prospective Tenant introduced to You by via the website or by other means renting or property uploaded by You onto LetBritain website or any other property of Yours. It is irrelevant whether you and the prospective tenant have followed the viewing and rental process set out in these terms. In the event LetBritain becomes aware of any attempt to circumvent the requirement to pay the Landlord Fee when payable, LetBritain shall: enforce all rights against you.

1. Definitions

Payable by you to Letbritain in respect of any prospective tenant/tenants introduced to you by LetBritain. “Advertisement Fee” means fee:

Featured property section: £9.99 payable by a prospective landlord for each advertisement Package means letbritain.co.uk letting packages;

“Tenant Finder” means the Package of Services provided by letbritain.co.uk for a fixed fee of £82.50 + £16.50 (VAT) = £99.00

“The Essentials” means the Package of Services provided by letbritain.co.uk for a fixed fee of £124.16 + £24.84 (VAT) = £149.00

“Everything You Need” means the package of Services provided by letbritain.co.uk for a fixed fee of £149.16 + £49.84 (VAT) = £299

“LetBritain” means Let Britain Global Limited, Company Number 09600585 whose registered office is 62B Chobham Road, trading as LetBritain.

“Site” means the website operated by Let Britain.

“Terms” means these terms and conditions which apply between LetBritain and You.

“You” means you, the prospective landlord who has registered as such on the

Site and “Your” and “Yourself” shall be construed accordingly.

2. Entering into a legally binding contract

By clicking the box on our Site marked “I have reviewed the Landlord’s Terms and Conditions and hereby agree to them”, You hereby agree that a legally binding contract between You and Let Britain comes into force on these Terms including but not limited to Your obligation to pay , the Featured Property Fee and the Landlord Package Fee as applicable.

3. Registration

3.1. In registering on the Site with LetBritain, You are required:

(a) to provide LetBritain via the Site true and accurate details of Your full name, telephone contact details, email address, date of birth and any other details required in the registration process;

(b) To pay the Package Fee by the means specified during the registration process on the Site.

3.2 You warrant and represent that all such details given by You in the registration process shall be true and accurate.

4. Advertisement Fee and Uploading of Properties onto the Site

4.1. In the process of uploading a property onto the Site you will be required to provide various property details (hereinafter “Property Details”) including property type, location, number of bedrooms, number of reception rooms, number of bathrooms/toilets and whether the property has a garden, an inventory and details of the deposit. You will also require a Landlord to provide an EPC, Gas & Electricity Certificate, form of ID and Proof of address.

4.2. You warrant and represent that all Property Details provided by You in the uploading process shall be true and accurate and you hereby indemnify and agree to hold LetBritain and its officers, directors, employees, agents and representatives, (each, an “Indemnified Party”, collectively, the “Indemnified Parties”), harmless from, against and in respect of any and all claims, costs, expenses, damages, penalties, liabilities or losses (including, without limitation, lawyers’ fees and disbursements and other costs and expenses incidental to any law suit, action, investigation or proceeding, collectively "Losses") which may be asserted against, imposed upon or incurred by any of the Indemnified Parties, by reason of, resulting from or in connection with any inaccuracy in or breach of this representation or warranty, made by You.

5. Purpose of registration

Registration with the Site and the payment of the Landlord Package Fee for each property uploaded shall enable You to upload Your properties available for letting onto the Site so that they can be viewed by prospective tenants registered as such with Let Britain.

6. Viewing and Rental Process

6.1. If a prospective tenant wishes to view a property registered by you on the Site he or she will be advised to contact LetBritain by telephone or by email. LetBritain shall then forward the enquiry via the dashboard

6.2. If following:

(a) Let Britain giving You the prospective tenant’s contact details or putting You in touch with the prospective tenant; and/or

(b) the viewing of that property by the prospective tenant; or

(c) any discussion or meeting between You and the prospective tenant the prospective tenant notifies Let Britain that he or she wishes to rent the viewed property or any other property of Yours (whether registered on the Site or otherwise) Let Britain will notify You accordingly. If however the prospective tenant notifies You he or she wishes to rent the viewed property or any other property of Yours (whether registered on the Site or otherwise), You must advise the prospective tenant to notify LetBritain. In addition You must also notify LetBritain of this by email and by telephone.

6.3. LetBritain shall then obtain copies of the prospective tenant’s three most recent bank statements, a copy of his or her passport and suitable work references evidencing both his or her ability to pay the rent and his or her good standing. LetBritain shall then forward such documents to such reference agency of its choice who shall carry out on Your behalf such references and financial checks on the prospective Tenant as LetBritain considers reasonably necessary. This shall be at Your cost but shall be offset against the package Fee payable by You. Let Britain shall forward such references, reports and checks to You but LetBritain shall have no liability for the contents or accuracy of any such references reports and checks.

6.4. You shall then notify LetBritain in a timely manner whether the reference and financial checks are or are not acceptable to You and of any other requirements and in the former case where You agree to let Your property to the prospective tenant Let Britain shall notify the prospective tenant that the various checks are acceptable to You and ask the prospective tenant whether he or she still wishes to proceed with the letting.

6.5. If the prospective tenant still wishes to proceed LetBritain shall notify You.

6.6. The package fee is payable upon registration with LetBritain.

6.7. Once you and the tenant have agreed to proceed with the let, LetBritain shall prepare and forward to You and the prospective tenant a draft tenancy agreement to be signed by You and the prospective tenant accordingly and returned to LetBritain. Copies of the executed tenancy agreement will then be sent by LetBritain to both You and the prospective tenant.

6.8. The package fee shall not be refundable to You in any circumstances including but not limited to the following:

(a) if following payment You subsequently decide for whatever reason not to let the property to the prospective tenant; or

(b) if the prospective tenant subsequently decides not to rent the property from You.

6.9. Letbritain cannot be responsible for any poor experience at the time of viewing or not maintaining the tenancy

7. Landlord Fee

7.1 The Landlord Fee shall be payable by You to LetBritain at the time set out in clause 6.6 above.

7.2 The Landlord Fee shall be exclusive of Value Added Tax which shall be added and paid by You in addition at the current rate in force from time to time.

7.3 Once a tenant lead is sent to the landlord via LetBritain the package becomes non-refundable.

7.4 LetBritain shall be entitled to charge interest on overdue payments of the Landlord Fee and applicable VAT (both before and after judgment) at the rate of 8% per annum or 3% above the Bank of England base rate as varied from time to time, whichever is the higher.

8. Ownership and Accuracy of Property Details

7.1 The details of properties have been prepared by You and will following Your registration be incorporated in good faith into the Site by LetBritain. However, LetBritain has no way of ensuring nor takes any steps to ensure:

You have good and proper title to any of these properties; and the accuracy of any particulars or details given by You in respect of such properties which are uploaded by LetBritain on the Site.

7.2 It is Your responsibility to ensure all such matters and no warranty or representation is given by LetBritain in this regard nor should any such warranty or representation be construed or implied as a result of the property appearing on the Site. The warranty, representation and indemnity given by You to LetBritain in section 3 is hereby repeated.

8. Planning building regulations and consents

8.1 LetBritain takes no steps to verify or check that any property appearing on the Site has all or any necessary planning, building regulation or other consents and in no circumstances shall LetBritain bear any liability in respect of any such matters which is hereby excluded. These are matters which are entirely your responsibility.

9. Services equipment and facilities

LetBritain takes no steps to verify or test any services, equipment or facilities at any of the properties listed on the Site. These are matters which are entirely Your responsibility.

10. Development Plans

LetBritain takes no steps to verify or check with regard to any properties listed on the Site any development plans, tree preservation orders, ancient monument orders, town planning schedules and resolutions, which may or may not come into force. These are matters which are entirely Your responsibility.

11. Rights of way

LetBritain takes no steps to verify or check with regard to any properties listed on the Site any rights of way whether public or private, light, support, drainage, water and electricity supplies and other rights and obligations, easements, quasi-easements and restrictive covenants, and all existing and proposed way leaves, poles, pylons, drains, water pipes whether referred to in property particulars appearing on the Site or otherwise. These are matters which are entirely Your responsibility.

12. Statutory Obligations/Codes of Practice

LetBritain gives no representation or warranty as to the accuracy of any description(s) of properties uploaded onto the Site which have been prepared by You. Subject to this LetBritain shall comply with all statutory obligations upon it and shall use all reasonable endeavours to comply with the all relevant codes of conduct.

13. Conflicts

LetBritain shall disclose to You any connection of which it is aware that a prospective tenant may have with LetBritain or any member of LetBritain’s staff so that all parties to any transactions are aware of possible conflicts of interest.

14. Damage caused by access to Site

While LetBritain endeavours to see that the Site is free from viruses or defects, it cannot guarantee that Your use of the Site or any websites accessible through it will not cause damage to Your computer. It is your responsibility to ensure that the right equipment is available to use the Site. Except in the case of actionable negligence on the part of LetBritain, LetBritain will not be liable to You or any person for any loss or damage which may arise to computer equipment as a result of using the Site.

15. Notices

Unless otherwise expressly stated in these Terms, all notices from You to LetBritain must be in writing and sent to our contact address at 62B Chobham Road, London E15 1LU or emailed to us at info@letbritain.co.uk. Notices from LetBritain to You will be displayed on the Site from time to time if not specifically communicated to You by email or otherwise.

16. Changes to Terms

LetBritain reserves the right to change these Terms from time to time and therefore You should look through them from time to time.

17. Invalidity

If any of these Terms or any part of them is unenforceable (including any provision in which Let Britain excludes its liability to You) the enforceability of any other part of these Terms will not be affected.

18. Contracts (Rights of Third Parties) Act 1999

For the purpose of the Contracts (Rights of Third Parties) Act 1999 these Terms are not intended to and do not give any person who is not a party to them any rights to enforce any of the provisions contained herein.

19. Governing Law

These terms and conditions shall be governed by English law and You and LetBritain submit to the exclusive jurisdiction of the English courts to determine any disputes.

I confirm my full understanding & agreement to the terms under which a deposit is paid.

  • Entering a legally binding contract
  • By clicking this box on our site marked “I have reviewed the Tenant’s Terms and Conditions and hereby agree to them”, you hereby agree that a legally binding contract between you and LetBritain comes into force on these terms including but not limited to your obligation to pay the fee.
  • Registration
    In registering on the site with LetBritain you are required to provide to LetBritain via the site true and accurate details of your full name, telephone contact details, email address, date of birth and any other details required in the registration process. You warrant and represent that all such details shall be true and accurate.
  • Purpose of registration
    Registration with the site shall enable you to have access to the properties registered on the site by prospective landlords for letting.
  • A holding deposit is payable upon your request to rent a property. Upon receipt of the holding deposit, the parties will enter into an agreement to reserve the property subject to the landlord receiving satisfactory replies to the referencing checks, Right to Rent checks and other pre-tenancy enquires. Letbritain will take the property off the market whilst the applicant completes the referencing process and the terms of the tenancy and any guarantee agreement are negotiated.
  • Should the applicant decide not to enter into a tenancy and withdraw their application at any time, fail to pass the checks detailed above, be found to have provided inaccurate or misleading information, or seek to impose tenancy conditions which the landlord considers unacceptable then the property will be placed back on the market. The holding deposit will be retained by Letbritain to pay for the cost of any referencing and credit checks undertaken, the cost of any guarantor agreement (if applicable), the cost of re-advertising the property to let and compensate the landlord for the loss of opportunity to rent to another tenant for the time that the property was off the market.
  • If the landlord should decide not to rent the property to the applicant for any reason other than those set out above then the holding deposit will be returned to the applicant in full.
  • If the applicant enters into a tenancy for the property with the landlord then the holding deposit will be credited to the applicants, guarantors rent account.
  • Initials must be signed by the landlord and tenant on both the tenancy agreements provided by LetBritain for the agreement to be legally binding.
